1. Acceptance of Terms

By accessing or using 365 Entertainment ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

You must be at least 18 years old to use our Services. By using the Platform, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

Important: These Terms constitute a legally binding agreement between you and 365 Entertainment regarding your use of the Platform.

2. Description of Service

365 Entertainment provides a platform for content creators to upload, share, and monetize their content. Our Services include:

  • Content hosting and distribution
  • Monetization tools and payment processing
  • Analytics and audience insights
  • Creator tools and resources
  • Community features

We reserve the right to modify, suspend, or discontinue any part of the Services at any time.

3. Account Registration

3.1 Account Creation

To use certain features of the Platform, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Be responsible for all activity under your account

3.2 Account Restrictions

  • You may only maintain one active account
  • You may not transfer or sell your account
  • You may not share your login credentials
  • Accounts must be registered to individuals, not entities (unless approved)

4. Creator Agreement

4.1 Revenue Share

Creators receive 70% of all revenue generated through the Platform. 365 Entertainment retains 30% to cover platform operations, payment processing, and support services.

4.2 Payment Terms

  • Payments are processed monthly
  • Minimum payout threshold: $50 CAD
  • Creators are responsible for applicable taxes
  • Chargebacks may be deducted from future earnings

4.3 Tax Responsibilities

Creators are responsible for reporting all income and paying applicable taxes. We will provide tax documentation as required by law.

5. Content License

5.1 Your Content

You retain all ownership rights to your content. By uploading content to the Platform, you grant us a non-exclusive, worldwide, royalty-free license to:

  • Host, store, and display your content
  • Distribute your content to users
  • Promote your content on and off the Platform
  • Modify content for technical processing (transcoding, etc.)

5.2 Content Standards

All content must:

  • Be created by you or you must have all necessary rights
  • Comply with our Acceptable Use Policy
  • Not violate any laws or third-party rights
  • Feature only individuals who have consented to appear

6. Payment Terms

6.1 How You Earn

Creators earn revenue through:

  • Subscription fees from fans
  • Tips and donations
  • Premium content sales
  • Other monetization features we may offer

6.2 Payment Methods

We currently support payments via:

  • Direct bank transfer (EFT)
  • PayPal

7. Termination

7.1 By You

You may terminate your account at any time by contacting support. Upon termination:

  • Your content will be removed from public view
  • You will receive any outstanding earnings (subject to minimum threshold)
  • Your license to use the Platform ends immediately

7.2 By Us

We may suspend or terminate your account for:

  • Violation of these Terms
  • Violation of our Acceptable Use Policy
  • Fraudulent or illegal activity
  • Non-payment of fees (if applicable)

8. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Availability or uptime

We do not guarantee any specific level of earnings or success on the Platform.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 365 ENTERTAINMENT SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, or data
  • Personal injury or property damage

Our total liability shall not exceed the amount you have earned through the Platform in the preceding 12 months.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to conflict of law principles.

Any disputes arising from these Terms shall be resolved through binding arbitration in Victoria, British Columbia, unless otherwise agreed.
